What happens if the testator’s son converts to Islam after marrying a Muslim?
**Q:**If a non-Muslim testator leaves assets to his son, but the son later marries a Muslim and converts to Islam, how
will the inheritance work?
**A:**If the testator is non-Muslim at the time of death, the estate will be distributed according to non-Muslim
inheritance laws in Malaysia. The son can still inherit from the testator even if he has converted to Islam.
However, because the son is Muslim at the time of death, the distribution of his own estate in the future will be
governed by Islamic inheritance law (Hukum Faraid).
Under Islamic law:
- The son can only give up to one-third (1/3) of his estate through a Will to non-Muslim beneficiaries.
- The remaining two-thirds (2/3) must be distributed according to Faraid to eligible Muslim heirs.
